HHSC allows an MCO to take enforcement actions against State-Required Personal Care Services providers, including those who are not in compliance with EVV Landline Phone Verification requirements, as described in the EVV Compliance Oversight Review Policy- Effective 2019.

The EVV Policy Handbook revisions, published and effective November 1, 2021, allow an MCO to take enforcement actions against State-Required Personal Care providers that are not in compliance with EVV Landline Phone Verification requirements for dates of service that are on or after November 1, 2021.

MCOs are not permitted to take enforcement actions against State-Required Personal Care providers that are not in compliance with EVV Landline Phone Verification requirements for dates of service September 1, 2020 through October 31, 2021. EXCEPTION: An MCO may take an enforcement action under these circumstances if an MCO is allowed to do so in its contract with a provider.
